Code Hero Crowdfunding Project on Kickstarter: On or Off?

There were reports popping up there was a Kickstarter crowdfunding deal gone bad.  An article on Cult of Mac claimed, “Creator of Educational Game ‘Code Hero’ Reportedly Spends Kickstarter Money And Disappears.

Code Hero was a much reported  crowdfunding project that was a “Game That Teaches You To Make Games”.  Having raised over $170,000.oo dollars to date (having had a $100,000 goal) from over 7,400 backers this Kickstarter was heading into the realm of success.  Unfortunately at some point the project leaders went dark.  As the title of the article on Cult of Mac inferred it sounded like the money was being spent not on the designated project but perhaps in a more frivolous fashion.

Since early in the year, Peake and Primer Labs haven’t been responding to backers, and now it’s been revealed that the educational tool will probably never see the light of day.

Dustin Deckard a concerned backer posting on the Code Hero Kickstarter blog stated yesterday,

And we’re off! Seems like this has all come to a head today. I’ve found evidence of Alex Peake’s scamminess dating back to 2008. He’s had several failed projects like this one. Keep an eye on your favorite gaming blog for more details (might I recommend Joystiq?),

In the following posts on Kickstarter lead developer of the Code Hero Project decided to surface for air generating analexpeake extensive post updating backers (and other interested parties) to their progress.  In brief Mr. Peake indicated everything is ok and on track guys – sorry for the lapse in communication.  Google hangouts included..

Code Hero development continues. We released the first alpha build of the game after PAX and we’re releasing alpha 2 soon to show you the latest progress.

And further down the missive;

Hello backer. I owe you a thanks for your support and an apology for our lack of updates on all the progress we’ve made with your help. I started the Code Hero project to make a game that teaches people how to make games and you backed us to help make that happen. We are going to finish this game for you and everybody else in the world who wants to learn how to code.

Code Hero DVDSo is this a breach of fiduciary responsibility by the Code Hero team?  Or just a simple case of miscommunication?  At best this is a pointed reminder for anyone generating a Kickstarter project the imperative nature of ongoing communication.
