While the crypto industry is disappointed that the Senate was unable to advance crypto infrastructure legislation in August, the CLARITY Act, Senator John Thune, Majority Leader, has filed cloture on the motion to proceed to HR 3633, or the CLARITY Act.
Thune has indicated that the bill will be “first thing” when the Senate comes back into session around September 14th.
A vote on the bill could occur as soon as September 15th, but time is short, as there are only a few weeks before attention shifts to the midterm elections, which could see pro-crypto Republicans lose control of the House or the Senate.

A vote on the bill requires 60 members in support to ensure there is no filibuster. As of now, it is not entirely certain the bill has sufficient bipartisan support to avoid the filibuster.
Senator Bernie Moreno, a Republican Senator who has been involved in the blockchain industry and who supports the bill, posted on X that an agreement was in place and he was confident that all Republican senators would vote in support of the bill, and Democrats have to make a decision as to whether the industry will be handed to China or the US will lead the way.

While Moreno believes Senate Democrats should and will support the bill, Patrick Witt, the White House’s lead on digital asset legislation, expressed less optimism, warning that if Democrats do not support the bill on the 15th, they never will.
Congress has been working on crypto market structure legislation for years at this point. The Senate alone has been actively negotiating the Clarity Act since last summer.

A significant factor in moving forward with crypto legislation is that it is an opportunity for the US to define how digital assets should be regulated and managed globally. As the US is the top global financial center, it is strategically important that crypto is regulated sufficiently to enable innovation while protecting participants.
Senator Moreno stated that consideration of the legislation is extremely important, anticipating a vote at 2:15 pm on Tuesday, September 15, 2026.
