Texas Governor Orders Audit of Data Centers Seeking Grid Access, Heightening Oversight of AI and Bitcoin Mining Facilities

Texas is intensifying its examination of large-scale power users as Governor Greg Abbott has instructed state regulators to thoroughly review every data center project seeking to connect to the Electric Reliability Council of Texas (ERCOT) grid. The August 3, 2026 directive requires the Public Utility Commission of Texas (PUCT) and ERCOT to complete a full verification and audit of all such projects before any can advance.

Facilities that do not meet the outlined standards or state law face denial of grid interconnection.

This move responds to an extraordinary surge in proposed demand.

ERCOT is evaluating roughly 474 gigawatts of interconnection requests—more than five times the grid’s previous peak electricity demand—with data centers accounting for about 90 percent of them.

Officials have warned that such rapid growth risks undermining the reliability and stability of the Texas electric system, which serves the vast majority of the state’s residents and businesses.

The audit builds on earlier guidance from June and focuses on several key areas.

Projects must detail any reliance on state or local tax incentives, grants, abatements, or other public financial support.

They are also required to outline projected annual and peak electricity use, along with plans for on-site generation or other steps to lessen dependence on the broader ERCOT network.

Water consumption receives particular attention: developers must report expected usage, supply sources, and cooling methods, with preference indicated for air-cooled, closed-loop, or other efficient systems that avoid straining community resources.

Additional disclosures cover community effects, including noise reduction, lighting controls, setbacks, traffic management, and emergency coordination tailored to local conditions.

Full information on ownership and controlling interests is mandatory.

The failure of some operators to respond adequately to prior surveys on power and water use helped prompt the order.

In response, ERCOT has postponed elements of its Batch Zero transmission planning process while implementing the directive.

These facilities encompass both artificial intelligence computing centers and Bitcoin mining operations, many of which have clustered in Texas due to relatively affordable power and available land.

Bitcoin miners have historically offered flexible, curtailable loads that can help stabilize the grid during peak stress, while AI-focused sites often demand more continuous, high-uptime power.

The heightened review applies across these categories as part of the broader data center queue, potentially delaying speculative or incomplete proposals while favoring those with clearer power arrangements, independent resources, and demonstrated community safeguards.

Analysts have noted that the pause could create scarcity around already-approved capacity, potentially benefiting existing operators with secured grid access or hybrid setups.

At the same time, the process aims to ensure new developments do not shift infrastructure costs onto residential customers or compromise system resilience.

Texas has positioned itself as a major hub for digital infrastructure, yet the scale of pending requests has elevated reliability and equity concerns to the forefront of state policy.

The audit does not rewrite underlying rules but enforces greater transparency and verification before projects proceed.

As AI workloads and cryptocurrency mining continue expanding their electricity footprints, Texas regulators are signaling that growth must align with grid integrity and local priorities. Outcomes of the reviews will shape the near-term trajectory of large-load interconnections across the state.
