When Will Crowdfunding Be Legal? State of the Industry Panel Sheds Light

This morning at #CrowdfundTX there was a panel discussion on the state of the crowdfunding industry.  I have to give credit where credit is due. Chris Camillo moderated the panel, and he led his questioning with perhaps the most important question of all.

“What is your best prediction of when title 2 and title 3 crowdfunding will become legal?”

That is the question, isn’t it? While our regulatory ecosystem works through the process of setting rules for crowdfunding, entrepreneurs hoping to participate in the space sit on the sidelines and burn money. Everyone wants to know when we’ll play ball.

Here are the opinions of the five panelists:

DJ Paul, GATE Technologies: Expects title 2 crowdfunding to be legal this quarter. As for title 3 crowdfunding, he’d be “ecstatic if it’s even remotely close by labor day.”

Scott Purcell, Arctic Island: Interesting that the chairwoman of the sec didn’t like it and “didn’t think it would be good for her legacy.” “I’m kind of pissed off… you should be pissed off, too.”

Candace Klein, SoMoLend: Slightly horrified by Purcell’s rather entertaining rant, she sought to clarify. “We dont hate the SEC.” If Elisse Walter called the rules forward today there would still have to be a 90 day public comment period, some reaction time, and then FINRA would have some time to pull their own rules together.  According to Candace, fall is the earliest we see this process completed. However, she said it is “very possible we see movement in next month or so.” She admitted to being more nervous about title 2 than title 3 and much more opportunity for title 3 to be passed before title 2.

Kim Wales, Wales Capital: What we’re going to see is a simultaneous release of the rulemaking process. Title 2 was scheduled to go live in July 2012 and that didn’t happen. The public comment period lasted until October 5th. We still have unemployment of 7.8%. However, Elisse Walter is in her role for one year and this is an opportunity for her to build her legacy. Ms. Wales expectation is six months until the release of both title 2 and 3. This was the most optimistic timeline offered.

Maurice Lopes, EarlyShares: “The little bird tells us the rules are made and sitting on a desk ready to be passed. I truly believe it will be this year.”
