Agency 2.0, the jilted firm that made it possible for the Sondors eBike to become the 2nd most funded campaign ever on Indiegogo, has just distributed legal documents to the media that share insightful details into the unseemly battle with Ivars Sondors. In a brief missive emailed out to the press, Chris Olenik, founder of Agency 2.0, stated;
Dear Media Members,
Please find attached to this email Declarations signed by both myself and Storm Sondors relating to a court hearing scheduled for May 6, 2015.
These are publicly filed documents. I believe these documents speak for themselves.
Backers of the Sondors eBike campaign, along with other interested parties, may view these documents embedded below. The two separate filings include: A Declaration of Chris Olenik in support for injuctive relief and; Declaration of Sondors in support of opposition (of course).
As has been widely disseminated on these pages, and elsewhere, Agency 2.0 has affirmed that Ivars (or Storm) Sondors had a contractual arrangement with the marketing firm but has refused to pay his legally agreed upon bill:
“Non-payment of hundreds of thousands of dollars rightly owed to [Agency 2.0] is very damaging, as it would be for any small business, and is causing us irreparable injury. We simply do not have the financial ability to spend over 4 months of work on a campaign, which included countless hours, to advance costs and then not get paid once the campaign is over. In the crowdfunding industry it is customary for the company managing the campaign to be paid at the end of the campaign”
The statement by Olenik and Agency 2.0 continues; “it has become very clear that he never intended to abide by the terms of the contract”.
Ivars in his statement quickly dispenses with his former partner Jon Hopp;
“John Hopp is not an officer, director or other authorized representative of Pacific Storm, Inc. John Hopp has not received funding from the Indiegogo.com campaign that is the subject of Plaintiff’s Motion. Mr. Hopp was not authorized to sign the agreement asserted by Plaintiff on behalf of Pacific Storm, Inc.”
Then Ivars simply states that not all Indiegogo funding has been disbursed and the plaintiff (Agency 2.0) has not provided sufficient information and services to the campaign.
Pacific Storm, Ivars company, states that if they are not able to access and use Indiegogo funds then that will prevent manufacture and distribution of eBikes to backers.

Clearly Ivars would have never been able to raise over $5 million without the assistance of Agency 2.0. The remaining question is will bikes begin to deliver in May? Ivars / Storm is apparently in China now, ostensibly preparing eBikes for shipment in the next few days.
